Understanding the R-1 Visa: Who is Eligible?
If you are part of a religious organization and looking to work in the U.S., the R-1 visa might be the right path for you. But what exactly is an R-1 visa, and who is eligible to apply?
What is an R-1 Visa?
The R-1 visa allows foreign nationals to enter the U.S. to work in a religious capacity for a recognized religious organization. This visa is designed for ministers, and others coming to the United States to perform a religious vocation or occupation, in either a professional or nonprofessional capacity.
Who Can Apply?
To be eligible for an R-1 visa, you must:
Be a Member of a Religious Denomination: You need to have been a member of a recognized religious denomination for at least two years prior to your application. For example, if you’ve been an ordained minister in a Catholic Church or a monk in a Buddhist temple, for at least 2 years prior to filing your application, you meet this requirement.
Qualify to Work in a Religious Capacity: The role you plan to fill in the U.S. must be a ministerial position, a religious occupation, or a religious vocation in which you have the qualifications to fulfill. For instance, you could be a pastor leading a congregation, a religious instructor teaching theology, or a nun fulfilling her religious duties within a convent.
Have a Job Offer from a U.S. Religious Organization: A U.S.-based religious organization must sponsor your visa application. This organization must be a nonprofit, tax-exempt entity that can support you during your stay. For example, a church, mosque, synagogue, or other religious-based organization, could sponsor your R-1 visa, provided they are recognized as a nonprofit under U.S. law.
Why Choose an R-1 Visa?
The R-1 visa is a great option for religious workers because it does not involve the demanding, strict, and lengthy requirements of the PERM process which applies to most other employment-based petitions, and it offers the flexibility to bring your family, for up to 5 years, with the potential to apply for permanent residency down the road.
